Terms and Conditions

Effective date: October 15, 2026

These Terms and Conditions apply to www.visycommunication.com and services supplied by Visual Information Simulating Years Communication, trading as Visy Communication, registered in St Catherine, Jamaica (“we,” “us,” or “our”).

1. Our services

We provide creative and communication services, including branding, graphic design, website development, social media marketing, photography, video, and content creation.

Each project’s scope, deliverables, fees, payment schedule, revisions, and estimated completion dates will be set out in a written quotation, proposal, or service agreement. A project-specific agreement takes priority over these Terms if there is a conflict.

These Terms will be provided or linked before you accept a project. Acceptance of the relevant quotation, proposal, or service agreement confirms your agreement to the terms incorporated into it.

2. Payments

Payments are made by bank transfer using the details provided on our invoice or through an authorised business communication.

The applicable currency, amount, deposit requirements, and payment dates will be specified in your quotation or invoice. Work may depend on receipt of the agreed payment and required project materials.

Any additional work or expenses outside the agreed scope must be approved in writing.

3. No-refund policy and cancellations

Payments are non-refundable, including where a client changes their mind, cancels a project, or chooses not to use completed work, except where a refund or other remedy is required by applicable law or expressly agreed in writing.

Nothing in these Terms excludes or restricts consumer rights or remedies that cannot lawfully be excluded.

Please send cancellation requests to info@visycommunication.com. Any outstanding payment obligations will be determined by the accepted project agreement and applicable law.

If we cannot deliver an agreed service, we will contact you to resolve the matter in accordance with the project agreement and your legal rights.

4. Client responsibilities

You agree to provide accurate instructions, necessary materials, and timely feedback and approvals.

You are responsible for ensuring that you have permission to use any text, images, logos, recordings, personal information, or other materials supplied to us.

Please review proofs carefully before approving publication, printing, or launch. Changes requested after approval may require additional fees and revised timelines, subject to written agreement. This does not remove our responsibility for errors attributable to us.

5. Timelines and revisions

Project timelines depend on the agreed scope and timely receipt of payments, materials, feedback, and approvals.

Changes in scope or delays in receiving these items may affect delivery dates. We will communicate material changes to the schedule.

The number of included revisions will be stated in the project agreement. Additional revisions require agreement on any extra charges.

6. Intellectual property

Ownership and permitted use of project deliverables will be specified in the project agreement. Payment alone does not determine whether copyright or editable source files are transferred.

Third-party materials, including fonts, stock images, software, and plugins, remain subject to their respective licences.

Our website content may not be copied, sold, or commercially reused without permission from the relevant rights holder, except where permitted by law.

Any use of client work in our portfolio will be subject to the project agreement, confidentiality obligations, and necessary permissions.

7. Third-party services and results

Projects may depend on hosting companies, social media platforms, software providers, or other third parties. Their terms, fees, and availability may apply.

We do not guarantee particular sales, search rankings, follower counts, engagement levels, or other business outcomes unless expressly agreed in writing.

8. Website use

You must not misuse this website, attempt unauthorised access, introduce malicious software, submit unlawful material, or infringe another person’s rights.

Links to external websites are provided for convenience. We do not control their content or practices.

9. Responsibility and disputes

Each party remains responsible for its obligations under the project agreement and applicable law. Nothing in these Terms excludes liability that cannot lawfully be excluded.

Please raise concerns promptly by emailing info@visycommunication.com and providing the relevant project or invoice details. We will seek to resolve the matter directly with you. This does not prevent you from exercising statutory rights or contacting the relevant authorities.

10. Governing law and changes

These Terms are governed by the laws of Jamaica, subject to any mandatory protections that apply.

We may update these Terms by publishing a revised version with a new effective date. Changes will not retrospectively alter an existing project agreement without agreement between the parties.
